Terms and Conditions
Release and Assumption of Risk
I clearly accept and understand that there are inherent dangers and risks involved in the activities of climbing, alpine activities, skiing, snowboarding, snowshoeing and different types of outdoor and alpine activities, including that of personal injury, paralysis and death.
I understand the hazards of climbing, alpine activities, skiing, snowboarding, and different types of outdoor activities, including abseiling off route, include by way of example and not limitation, the following: falling because of improperly placed gear, in snow ice or rock, loose or crumbling rock, bolted climbs indoor or outdoor, or climbs that are not properly protectable, falling because of improperly tied knots, or rope technique, or improperly buckled harnesses, or because of avalanches of snow ice or rock, or falling into or over/off crevasses or cliffs/buildings, or falling onto a ledge or other protrusions.
I understand that rescue may not be available if I hurt myself, and that even if available rescue attempts may fail or be slow. understand that there are more hazards than can be documented here and that there are unknown and unforeseeable hazards.
I understand that the above type of activities have a high degree of wear and tear on equipment and could be so damaged that the gear becomes unsafe to use. I will bring this to the attention of the excursion leader. My own gear may fall into this category.
I engage in the activities listed above with the full knowledge of the inherent risks of injury, paralysis or death that may result. I agree to participate in these activities at my own risk.
I therefore for myself, my heirs, successors, and representatives KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE AND AGREE TO INDEMNIFY,HOLD HARMLESS,AND DEFEND INDEPENDENT MOUNTAIN GUIDES AND ITS INSTRUCTORS, GUIDES, RIGGERS,OFFICERS,DIRECTORS,AGENTS,ASSIGNEES OR THEIR ESTATE, from any and all liability for any and all such damage, injury, paralysis or death to myself or any other result, whether such damage injury, paralysis or death results from the NEGLIGENCE OF IMG, ITS INSTRUCTORS, OFFICERS, DIRECTORS, AGENTS, ASSIGNEES, OR THEIR ESTATES from some other cause.
I further agree for myself, my successors, heirs and family not to sue IMG, its instructors, officers directors, agents, assignees or their estates, on account of any injures I incur in conjunction with this IMG programmer in connection with any activities, occurring during the course of this IMG programme, including travel to and from where the area where this course or trip takes place.
Poor fitness or personal medical or injuries whilst on an IMG trip is the responsibility of the participant and any extra costs that incur to IMG because of this is payable by the participant.(NZ ACC does cover most injury treatments or evacuation due to injury within NZ).
I understand the risks of climbing alpine activities as per above and I have carefully read understand and voluntarily accept the terms of this waiver and release agreement.
This release applies to each and every IMG programme I participate in now and in the future. This contract is severable that is if any part of it is held by a court of law to be unenforceable, the rest of it shall nevertheless be effective.
CANCELLATION AND REFUND POLICY
Independent Mountain Guides reserves the right to cancel any trip due to adverse conditions or issues beyond their control. Full refunds will be made in this event.
We also reserve the right to change aspects/location of the trip due to poor weather/ high rivers/ snow safety issues.
If you (the participant) cancel any trip or part thereof for any reason the refund policy is as follows:
- Cancellation within 48 hours no refund.
- Cancellation within the period of the trip no refund. Cancellation within 7 days of the trip a full refund minus the deposit.
- Cancellation within 20 days a full refund.
Participants should have travel and activity insurance in place should these events transpire, to protect themselves.
